The lack of governmental backing does not lessen the the magnitude of the attacks. It does present problems relative to the Geneva Conventions because the conventions were specifically crafted to deal with handling the soldiers of the states and countries that might go to war with one another. Radical Islam declared war, Holy War, on America soon after the Taliban ousted Russia from Afghanistan. Ironically, the Taliban likely would not have managed to push the Russians out if the West had not supported them. The Taliban IS radical Islam. Others are also radical Islam, but the 9/11 attacks grew out of Islamists more closely linked to the Taliban and al Qaeda than any of the other radicalized Islamists around the globe. But, you're an idiot that has had this explained to you so many times that the letters are wearing off of my keyboard. Bringing the Gitmo Five to trial in New York would be akin to bringing the Japanese Empire to trial in Hawaii for bombing Pearl Harbor. This is a wartime issue, not a criminal issue. There is no place in American jurisprudence to try these guys in criminal courts.

As I said, this is all for Political Correctness. There are a few things that come into play in a Civilian court that wouldn't in a Military Tribunal. First of all, they are saying 'they will have all the rights afforded to anyone tried in a US court". Oh, really?!?!?! Well, have they ever been Mirandized? NO?!?!?! Well, then, their rights have been abused! No case. Thrown out on a technicality. I'm sure there are HUNDREDS of 'technicalities' that will pop up in this 'trial'. Here's another one: "Your honor, my clients cannot get a fair trial here, a block away from the site of the WTC. I am asking for a change of venue, and suggest this trial be heard in the 7th District court." (For those that don't know, the 7th Federal District is...San Francisco... Or, is that the 9th? If you really care, google it... These people are buffoons. This is a case of terrorism against the US by enemy combatants, and should be tried as such. Political Correctness bullshit. |
